Terms & Conditions

The Live to Earn desktop application and website (together, the "Service") are operated by LIVE TO GIFT LTD, a company registered in England and Wales ("we", "us"). These Terms & Conditions ("Terms") govern your use of the Service. By creating an account, downloading, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. About the Service

Live to Earn is a Windows desktop application that connects to your TikTok Live stream and simulates keyboard input on your own PC in response to stream events (gifts, likes, follows, shares, chat messages and joins), based on rules you configure yourself.

2. Accounts

• You must provide accurate information (name, email) when creating an account and keep it up to date.
• You must be at least 18 years old, or the age required to receive gifts on TikTok Live in your country, whichever is higher.
• You are responsible for keeping your password confidential and for all activity under your account.
• Accounts are personal. Sharing, selling or transferring an account is not allowed and may lead to suspension.

3. License & Device Limit

We grant you a personal, non-exclusive, non-transferable license to install and use the application for your own streaming. One account may be used on one (1) device at a time. Logging in on a new device may require releasing the previous one. You may not copy, modify, resell, decompile, reverse-engineer or redistribute the software, or attempt to bypass its license, plan or device restrictions.

4. Plans, Billing & Cancellation

• The Service offers a Free plan and paid subscription plans (Basic, Pro) with different feature limits. Features of each plan may change over time.
• Paid subscriptions are billed in advance on a recurring basis through our third-party payment provider. Prices are shown at checkout.
• You can cancel at any time; your plan stays active until the end of the paid period, after which your account moves to the Free plan.
• If a payment fails, is disputed, charged back or reversed, we may downgrade, suspend or limit access to paid features until the matter is resolved.
• Refunds are handled under our Refund Policy. Nothing in these Terms limits any refund, cancellation or consumer rights that cannot be excluded under the laws that apply to you.

5. Acceptable Use

You agree not to:

• use the Service for anything illegal or to harm others;
• use the Service to violate the terms of TikTok, any game, or any other platform;
• interfere with, overload or disrupt our servers, or access them by any means other than the app and website;
• use bots, exploits or automation to abuse free plans, verification codes or promotional offers.

6. Third-Party Platforms

The Service reads publicly visible events from your TikTok Live stream and simulates key presses in games or software installed on your PC. TikTok and the games you play are third-party platforms with their own terms of service. You are solely responsible for making sure your use of Live to Earn complies with the rules of TikTok and of any game you use it with. We are not responsible for actions those platforms may take against your accounts, including suspensions or bans. See also our Disclaimer.

7. Viewer Data & Your Stream

The app processes information about people who interact with your live stream — such as usernames, gifts, likes, chat messages and joins — in order to run the rules you configure (including reading names aloud via text-to-speech). This processing happens for your stream, under your control. You are responsible for making sure your use of the Service complies with any notices, permissions or consents required for your audience and your country, and with the rules of the platform your viewers are on. Do not use the Service to collect or process private or sensitive information about viewers.

8. Your Content

Content you save to your account — such as cloud presets, event configurations and an optional profile picture — remains yours. You grant us a limited, non-exclusive, royalty-free license to store, copy and process that content only as needed to operate, sync and support the Service. We will not use your content for marketing without your permission. You are responsible for ensuring anything you upload does not infringe anyone else's rights.

9. Availability & Changes

We work to keep the Service available, but we do not guarantee uninterrupted operation. The app requires an internet connection to verify your account. We may update, change or discontinue features at any time, and may update these Terms — continued use after an update means you accept the revised Terms.

10. Termination

You may stop using the Service and delete your account at any time by contacting us. We may suspend or terminate accounts that violate these Terms, abuse the Service, or initiate fraudulent payments. On termination, your license to use the software ends.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose. We do not guarantee any level of income, viewers, gifts or stream growth from using the Service.

12. Limitation of Liability

To the maximum extent permitted by law, Live to Earn and its operators shall not be liable for any indirect, incidental, special or consequential damages — including lost profits, lost data, or actions taken by third-party platforms against your accounts — arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the three (3) months before the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

13. Indemnification

You agree to indemnify and hold Live to Earn and its operators harmless from any claims, liabilities, losses, costs and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your stream, your content, your breach of these Terms, or your violation of any law or the rights of any third party.

14. Governing Law

These Terms are governed by the laws of England and Wales, unless mandatory consumer protection laws in your country provide otherwise. Any disputes shall be brought before the courts with jurisdiction under applicable law.
